1. Acceptance of Terms

By downloading, installing, or using WidgetDash ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

WidgetDash is an iOS application and accompanying server infrastructure that allows users to push data from external sources and display that data on iPhone home screen and lock screen widgets. The Service includes the iOS app, the WidgetDash API, and the web dashboard.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials and API keys.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

You are solely responsible for maintaining the confidentiality of your API keys. Any data pushed using your write key is your responsibility.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Push, store, or display illegal, harmful, threatening, abusive, defamatory, or objectionable content.
• Attempt to gain unauthorized access to the Service, other accounts, or server infrastructure.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Reverse engineer, decompile, or disassemble the App.
• Use the Service for any purpose that is fraudulent or otherwise harmful.
• Transmit viruses, malware, or any other malicious code.
• Overload the Service with excessive API requests intended to degrade performance.

We reserve the right to suspend or terminate your account at any time if we reasonably believe you are violating these Terms.

5. User Data and Content

You retain ownership of any data you push to the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you.

You are solely responsible for the accuracy, legality, and appropriateness of all User Content. We do not monitor, review, or endorse User Content.

6. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as available" basis. We may:

• Modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
• Perform maintenance that may temporarily affect availability.
• Impose limits on certain features or restrict access to parts of the Service.

We are not liable for any downtime, data loss, or interruption of the Service.

7. API Usage

The WidgetDash API is provided for programmatic interaction with the Service. You agree to:

• Use the API in accordance with these Terms and any published documentation.
• Not exceed reasonable rate limits or use the API in a way that degrades the Service for other users.
• Keep your API keys secure and not share them publicly.

We reserve the right to throttle, restrict, or revoke API access at our discretion.

8. Intellectual Property

The Service, including the App, website, API, documentation, design, and all associated intellectual property, is owned by WidgetDash and protected by applicable copyright and intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it as described herein.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements.
• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from use of the Service will be accurate or reliable.
• Any errors in the Service will be corrected.
• Widget data will always be current, accurate, or displayed correctly.

You use the Service at your own risk. You are solely responsible for any decisions or actions taken based on data displayed through WidgetDash widgets.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WIDGETDASH, ITS OWNER, OPERATORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities.
• Loss of goodwill or reputation.
• Cost of procurement of substitute services.
• Any damages arising from reliance on data displayed through the Service.
• Any damages resulting from unauthorized access to or alteration of your data.
• Any damages resulting from service interruptions or downtime.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless WidgetDash, its owner, operators, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Any User Content you push to the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service ceases immediately.
• We may delete your account and all associated data.
• Sections 9, 10, 11, and 14 shall survive termination.

13. Third-Party Services

WidgetDash may interact with third-party services and data sources through user-configured integrations. We are not responsible for the availability, accuracy, or content of any third-party services. Your use of third-party services is governed by their respective terms and policies.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

You agree that any claim or cause of action arising from your use of the Service must be filed within one (1) year after the cause of action arose, or it shall be permanently barred.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and WidgetDash regarding the use of the Service and supersede all prior agreements and understandings.
